1. Acceptance of Terms

By accessing, downloading, or using the twork mobile application („the App“) and its related services, you agree to be bound by these Terms of Service („Terms“). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you („User“) and Twork („we,“ „us,“ or „our“).

2. Description of Service

Twork is a platform that allows users to discover, rate, and review laptop-friendly cafes and coworking spaces. The App allows users to upload photos, write text reviews, and connect with friends.

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time without notice.

3. User Accounts and Anonymity

3.1 Registration

To access certain features (e.g., posting reviews, adding friends), you may be required to create an account. You agree to provide accurate and current information during registration.

3.2 Public Anonymity

We respect your privacy. You have the option to use the App pseudonymously. This means your reviews and ratings can be displayed without revealing your real name to other users.

  • Internal Accountability: While you may remain anonymous to the public, your account is linked to your login credentials within our system. You are fully responsible and liable for all activities and content posted under your account, even if your profile is set to „anonymous.“

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized use of your account.

4. User-Generated Content (UGC)

4.1 Ownership and License

You retain all ownership rights to the text, photos, and other content you upload to the App („User Content“).

By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, and transferable license to use, reproduce, modify, display, and distribute your content solely for the purpose of operating, promoting, and improving the App.

4.2 Prohibited Content

You agree not to upload or post any content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful.
  • Infringes on the intellectual property rights or privacy rights of any third party (e.g., posting photos of people without their consent).
  • Contains spam, unauthorized advertising, or misleading information.
  • Contains malware, viruses, or harmful code.

4.3 Content Moderation and Reporting

We strive to maintain a safe and friendly community.

  • Reporting: Users can report inappropriate content (images or text) via the in-app reporting function.
  • Removal: We reserve the right, but have no obligation, to monitor User Content. We may remove any content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable, without prior notice.
  • Suspension: Repeated violations may result in the suspension or permanent banning of your account.

5. Privacy and Data Infrastructure

Your privacy is paramount. Our data processing is governed by our Privacy Policy. However, for transparency regarding our infrastructure, we disclose the following in these Terms:

5.1 Infrastructure Made in Germany

To ensure the highest level of data sovereignty, all our servers are located in Germany. We do not store your personal data on servers outside of the European Union.

5.2 Technical Services (Self-Hosted)

We use the following internal tools to operate the App. Unlike many other apps, we host these tools ourselves to prevent third-party data leakage:

  • Matomo (Analytics): Used to analyze app usage and improve user experience. IP addresses are anonymized.
  • Sentry (Debugging): Used to track errors and crashes to ensure app stability.
  • n8n (Workflow Automation): Used for backend processes and automation.

Because we self-host these services on German servers, your data remains within our controlled infrastructure.

6. Intellectual Property

The App itself, including its source code, design, layout, graphics (excluding User Content), and logos, is the property of [Your Name/Company Name] and is protected by copyright and other intellectual property laws. You may not reverse engineer, decompile, or attempt to extract the source code of the App.

7. Limitation of Liability

The App is provided on an „AS IS“ and „AS AVAILABLE“ basis.

To the maximum extent permitted by applicable law:

  • We do not guarantee that the information provided regarding locations (e.g., opening hours, WiFi speed) is accurate or complete, as this is largely based on user feedback.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App or any content therein.

8. Third-Party Links

The App may contain links to third-party websites (e.g., websites of cafes). We are not responsible for the content or practices of these third-party sites.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms on this page and updating the „Last Updated“ date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
